EA Also Updates ToS To Forbid Class Action Lawsuits
Well after seeing what Sony had done with their Terms of Service, Electronic Arts decided they had nothing to lose and everything to gain by updating theirs as well. While doing so they decided to forbid class action lawsuits, “By accepting these terms, you and EA expressly waive the right to a trial by jury or to participate in a class action.” The terms continue,
“If you and EA are unable to resolve a Dispute through informal negotiations within 30 days after receipt of the Notice of Dispute, either you or EA may elect to have the Dispute finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. YOU UNDERSTAND THAT BY THIS PROVISION, YOU AND EA ARE FOREGOING THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.”
If that wasn’t enough they state it one more time, “YOU AND EA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.” Yes, all of that is actually in caps in the document, and if that wasn’t enough, it’s bold too.
This has all been a reaction to the many lawsuits Sony had to face after Playstation Network went down for over a month.
